In 2023, the emergence of artificial intelligence (AI) caused quite a stir as it steeped into various aspects of both business and everyday life. This advanced technology has become an integral part of the modern world, prompting many to ponder whether it is a friend or foe. To shed light on this matter, Dr Pavan Duggal, Chief Executive of AI Law Hub and Advocate at the Supreme Court of India, delivered a speech at the BW Security World 40 Under 40 Awards in Delhi on Saturday.

Duggal emphasised that we need to understand the ramifications of artificial intelligence in the context of cybersecurity and other things. Citing the example of Ram Mandir, he added Centre is using AI to ensure impeccable security during the consecration of the Ram temple, serving as a prime illustration of the widespread implementation of AI in the realm of security.

Duggal underscored that the aforementioned instance may excite many to accept AI as their ally providing a secure ecosystem. However, just like a coin has two sides, this intelligent advancement can turn into a formidable enemy. Hackers and other cybercriminals are using AI to create more fraud, targeting stakeholders across the world.

The Davos Focus

The Chief Executive of AI Law Hub said AI is being discussed largely at the 55th edition of the global summit at Davos in Switzerland. He said that global leaders are deliberating on the need for AI regulation. In the Indian context, he stressed AI is not currently governed by existing laws, necessitating further efforts. Duggal further mentioned that ChatGPT 4, is like the ‘Sword of Damocles’ posing both opportunities and risks in terms of data security.

OpenAI’s New Project

The AI law expert further shifted his lens towards the much-anticipated project of OpenAI namely the ‘Super Intelligence Alignment Project’. He said within the next four years this project will introduce a groundbreaking form of super intelligence that surpasses human capabilities. Consequently, it is significant to initiate discussions regarding the legal aspects of this development today, rather than waiting until it is too late and difficult to regulate, stressed Duggal.

Safety In The Realm Of AI

While nations are examining strategies to safeguard their standing in the digital realm, China has taken the lead in the global race introducing groundbreaking legislation on generative artificial intelligence (Gen AI), which came into effect on 15 August 2023. This law is, by and large, the most exhaustive law as far as the legalities of Gen AI, according to Duggal.

Duggal’s perspective suggests that AI can have both positive and negative implications. However, a recent study has revealed that India faced an average of 2,138 cyberattacks per organisation every week in 2023, after the emergence of AI. This statistic indicates a 15 per cent increase compared to the previous year, 2022.

Additionally, the study revealed that a staggering 1 in every 10 organisations worldwide was hit by attempted ransomware attacks in 2023, surging 33 per cent from the previous year, when 1 in every 13 organisations received ransomware attacks.
